Petitioners Jose Angel Diaz Cervantes, S-H-, Mohammad Sancharki, and Mohammadreza Omidian are four noncitizens who are languishing indefinitely in immigration detention at the notoriously harmful Torrance County Detention Facility. Petitioners each came to the United States to seek protection from persecution or torture and find a better life. Their immigration proceedings have now concluded, and the Government is holding Petitioners in prolonged detention without a legitimate reason to do so. Since their immigration proceedings concluded, Petitioners have been detained between four and ten months with no end in sight. They’re continued detention is both unreasonable and unlawful.

On April 22, 2026, Petitioners filed this habeas petition in the District of New Mexico District Court to challenge their indefinite detention as a violation of the Due Process Clause of the Fifth Amendment, our immigration laws, and ICE’s own policies. Petitioners are seeking their immediate release from unlawful government custody.
