Case Details
For more than six months, Respondents have kept Petitioner Hadi Hajimohammadidibazar in detention without a lawful basis. In 2024, Petitioner was granted of withholding of removal from Iran. In June 2025, Respondents redetained Mr. Hajimohammadidibazar at his check-in without considering the relevant individual facts of his case and without any plans to actually remove him to a third country. Petitioner was instead swept up in Respondents’ dragnet of immigration enforcement meant to achieve “the single largest Mass Deportation Program in History” regardless of what the law requires before Respondents may deprive a person of their freedom. He is detained at the Torrance County Detention Facility in Estancia, New Mexico - a facility notorious for its dangerous and unsanitary conditions.
This case challenges the government's arbitrary and unlawful re-detention and indefinite detention of Mr. Hajimohammadidibazar in violation of his procedural and substantive due process rights under the United States Constitution, this country's immigration laws, and the Administrative Procedure Act. Mr. Hajimohammadidibazar is seeking a writ of habeas corpus to be liberated from detention.
