Case Details

For over 20 years, Petitioner Kang Jie Jiang has been living in the United States and contributing to his community. In 2003, the government released Kang Jie from immigration detention after they determined that they could not facilitate his order of removal to China. Since his release from custody over two decades ago, Petitioner complied with every request, demand, and requirement imposed by the government. Nevertheless, upon attending his scheduled annual ICE check-in on May 8, 2025, ICE re-detained Petitioner, not based on Kang Jie's individual facts or circumstances but based on the executive directive that they “do all in their power to achieve the very important goal of delivering the single largest Mass Deportation Program in History.”

Kang Jie has now been in immigration detention for over nine months with no end in sight, and he remains in custody at the Torrance County Detention Facility in Estancia, New Mexico. On February 18, 2026, Petitioner brought a petition for writ of habeas corpus challenging his re-detention and indefinite detention as a violation of the Due Process Clause of the Fifth Amendment and the Immigration and Nationality Act and its implementing regulations. 

Update: In June 2026, our client returned home to China, a place he had been trying to get back to for decades.
