After fleeing Iran to escape persecution, Mr. Ziaei sought protection in the United States. In the summer of 2024, he was granted withholding of removal and released from immigration detention on an order of supervision. Since that time, he fully complied with all legal requirements imposed by the government and has built his life in the United States. Despite this, in June 2025, Mr. Ziaei was re-detained at his regularly scheduled check-in with Immigration and Customs Enforcement without notice or explanation. Mr. Ziaei has now been detained for nearly five months at the Torrance County Detention Facility in Estancia, New Mexico - a facility notorious for its dangerous and unsanitary conditions.

This case challenges the government's arbitrary and unlawful re-detention and indefinite detention of Mr. Ziaei in violation of his procedural and substantive due process rights under the United States Constitution, this country's immigration laws, and the Administrative Procedure Act. Mr. Ziaei is seeking a writ of habeas corpus to be liberated from detention.
