Updates:

• On January 20, 2025, the Trump administration issued an executive order “Protecting the American People Against Invasion,” that orders a pause of funding to nongovernmental organizations “supporting or providing services,
  either directly or indirectly, to removable or illegal aliens” pending review and/or audit of funds.. For more information about this and other executive actions, please see our analysis here.
• In the same executive order, the Trump administration announced its intent “to prioritize the prosecution of criminal offenses related to the unauthorized entry or continued unauthorized presence” of immigrants. We recommend that organizations working with immigrants read the recent analysis from the National Lawyers Guild, Assessing Risks in Supporting Immigrants at Points of Intervention: Understanding the “Harboring” Non-U.S. Citizens Federal Crime, 8 U.S.C. § 1324(a)(1)(A).

In the context of an incoming administration that intends to prioritize mass deportation and mass incarceration, advocates and organizations must remain steadfast in their work to defend immigrant communities. At the same time, advocates and organizations must ensure that they also protect themselves from the threat of retaliation from state and federal actors.

Innovation Law Lab has prepared this toolkit for the Oregon For All coalition to help empower advocates and organizations that support immigrants and refugees so they can protect themselves throughout the fight ahead. By shoring up internal business compliance practices, strengthening digital security, and increasing capacity and preparation for interactions with law enforcement, organizations can help protect their missions, members, and the vital work they provide.
