BACKGROUND
More than 1,100 individuals have been swept and detained by ICE this year in communities across the state according to government data, with more than half since September 2025. Adding to the distress, ICE has frequently blocked attorneys from meeting with clients, quickly secreting Oregonians out of state. Loved ones and attorneys can sometimes wait for days to locate or communicate with them. Denial of access to counsel deprives community members of their due process rights and puts them at high risk of prolonged detention and deportation.
In October, attorneys at Innovation Law Lab filed a lawsuit against ICE, CBP, and DHS over denial of access to counsel on behalf of CLEAR Clinic and PCUN. The attorneys filed an amended complaint Nov. 13, adding a new plaintiff “Leon X” and seeking class action status. Plaintiffs also renewed their request for a preliminary injunction to ensure Oregonians have meaningful access to counsel before being transferred out of state.
ALSO THURSDAY December 18 is International Migrants Day and the first Day Without an Immigrant, an economic boycott for Oregonians to stand against the Trump administration's unlawful attacks on immigrant communities. PCUN, a plaintiff in this lawsuit, is organizing actions statewide.
